We reserve the right to change and amend the Terms at any moment in time. Changes to the Terms will be effective immediately upon notification on this website. Your continued use of the website following changes will represent an agreement by you to be bound by the Terms and Conditions as amended.
The Briary reserves the right to reject any order provided to us that we deem as possibly fraudulent. If we determine that fraudulent information is provided we will send an email or phone call to the sender to inform them of the situation to determine if the information was provided as an error.
Purchasing:
A contract for the sale and purchase of our products will only be formed with you if we, at our discretion, accept an order for goods from you. We accept your order when we:
A) Have received full contact details that includes your name, email address, billing address, phone number, recipient’s full name, delivery address, and delivery date
B) Have full payment or your account has been charged
C) We have contact you to confirm your order.
You can place an order on the website or call us at 478-295-0885 to place an order or a customized order that is not on our shopping cart.
To ensure your order to be fulfilled we require full payment, or you have an account(Net15) with us. Full payment is the purchase price that has been stated on invoice. If something is added another invoice will be generated and that will need to be paid to ensure your order is fulfilled. Orders will not be process until payment has been successfully processed and we have your full contact details.
Delivery:
It is your responsibility to ensure that a person is present to accept delivery. Unless specified delivery instructions are stated by you: Examples:
A) Leave at front door
B) Leave at back door
C) Leave with neighbors
D) Leave at reception
We do not take no responsibility if no one is present at the Delivery Address to accept delivery on the delivery date specified during checkout. The Briary is not responsible for any order where the recipient refuses the order to accept the items during delivery.
We will give a courtesy call to you if this does happen. If the courier or we do not hear from you regarding this matter, we will bring the product back to the point of dispatch and you will be responsible for the purchase no matter if you receive the product or not.
If a claim is made that the order was not delivered, please give The Briary a call and we ask that we are allowed at least 24 hours to determine what has occurred. If the delivery determines that: A) An incorrect Delivery Address was provided
1. You will need to pay for the product and delivery fee for a re-delivery to the correct address. 2. If the same bunch of flowers is to be re-delivered, you will need to pay for the additional delivery based on the location of the delivery.
B) If it is determined that The Briary did not make the delivery, it is our policy to provide you with a refund.
Our Products:
If an order is filled and delivered to the recipient and there is a question regarding the quality of the arrangement, products, etc., the recipient should contact The Briary at 478-295-0885. To request a replacement please allow The Briary within 24 hours of delivery.
*Please beware that flowers and plants are perishable. Proper care is required. It is the responsibility of the recipient to follow any care instructions provided by The Briary.*
*No refunds or replacements will not be made if The Briary is not notified within 24 hours of the original delivery date.*
The Briary will always attempt to fulfill an order as closely as possible. Many times, the images on the website showcase images or products that will need to be SUBSTITUTIONS ALLOWED:
A) Some flowers as seasonal, some flowers may be of different value outside of the Milledgeville and surrounding areas, and some flowers may not be available for delivery.
B) Containers, gifts, balloons, or other items that comprise the order also could be unavailable at the time of your order.
When the above statements occur, Our designers will substitute any unavailable flowers or products for those of a similar appearance and value, and you agree not to hold us responsible for any such variations.
If a customer needs to cancel a order:
A) The cancellation needs to be before delivery is made.
B) The cancellation could be subject to a 15% cancellation fee.
C) If the cancellation is received after delivery there will be no refund.
D) Cancellations will not be accepted if a customer places an order but provided wrong information that prevents direct delivery.
E) If the new address is outside the delivery range and The Briary cannot deliver it, only 50% of the order will be refunded.
If a customer picks up the arrangement, gift, or plant and has seen the quality of the flowers, it is the responsibility of the customer to maintain the integrity of the item that has been picked up. No refunds will be given if any questions about the quality of the arrangement are not given at the time of the pickup.
Orders which are not subject to refund include but are not limited to:
A) Weddings and Special Event Floral
B) Special orders or products
C) Customized orders
The Briary reserve the right to not accept changes to orders for delivery on special calendar events like Thanksgiving, Christmas, Valentine's Day, or Mother's Day.
The Briary reserve the right to refuse our service in any situation.
The customer or consumer of our product is to the maximum extent permitted by the law, at all times and from time to time indemnify and keep indemnified, us(owners) and agents, employees harmless from and against all liabilities, losses, damages, costs or expenses directly or indirectly incurred or suffered by the Indemnified Party, and from and against all actions, proceedings, claims or demands made against the Indemnified Party as a result of:
A) The use of thebriaryflowershop.com wedsite
B) The use of products purchased at The Briary
C) The cause of incorrect information provided by you
D) Any breach of these Terms and Conditions
Under Uncontrollable Reasons:
If because of any circumstance that is beyond our reasonable control, suggesting events such as war, strike, riot, flooding, snow, tornado, and/or act of God, we are unable to perform our obligation under this agreement, we are not liable of obligations that can not be performed under Uncontrollable Reasons.
Warnings:
All/Most of our products are not for human or animal consumption and we cannot be held liable for any damages incurred as a result of consumption.
We must know if the Recipient has any allergies to any particular types of flowers, plants, and items we sell in our store.
We are not responsible for any illegal use of this website or prohibited by laws that apply to you
We are not responsible for any damage to damage or computer issues caused by the connection or use of this website
We are not responsible for any losses due to unauthorized access to modification of your transmissions or data or information contained on your computer or this website.
This website may contain third-party links to other websites. We are not responsible for the content or privacy practices associated with linked websites or third-party advertisements that might incur as a result.
The Briary provides flower care, handling, floral design, or flower arranging. We offer flower delivery. We have unique gifts that would set you aside from the original gift ideas.
